The March 2, 2026, filing deadline for the Business, Professional, and Occupational License (BPOL) tax is rapidly approaching for Fairfax and Loudoun Counties―two of the largest and most active Virginia BPOL tax jurisdictions. While taxpayers often treat their BPOL tax filing requirements as routine compliance, the structure and complexity of the BPOL tax continues to create meaningful exposure, particularly for taxpayers doing business in multiple locations within Virginia.

Why BPOL Tax Matters

In the Commonwealth of Virginia, more than 100 localities subject all business owners to BPOL tax for the privilege of doing business within the locality. The BPOL tax is imposed on a taxpayer’s gross receipts (instead of their net income), and most allow few, if any, deductions, so businesses often owe BPOL tax in years when the business is operating at a loss for income tax purposes.

Key Compliance Challenges

Taxpayers face several challenges when complying with BPOL tax laws, such as

  1. Lack of Uniform Administration: Each locality administers its BPOL tax independently, creating confusion when determining the amount of tax due for taxpayers operating in multiple Virginia localities.

  2. Differing Tax Rates: Localities have different tax rates for the same activities or may differ in how they classify a taxpayer’s activities, leading to errors that apply across multiple tax jurisdictions.

Common Areas of Overpayment

The issues administrating a company’s BPOL tax obligations lead to overpayments in many ways, such as

  1. Taxpayers applying the incorrect tax rate to an activity in a locality because they used information that was used to determine BPOL tax in a different locality.

  2. The guidance available to determine BPOL tax expense is complex and hard to apply, leading to errors in calculating the correct amount of tax due.

Also, a taxpayer’s lack of experience in administering BPOL tax audits makes it difficult to challenge incorrect tax assessments and identify refund opportunities.
